Terms & Conditions – Castabroad Limited
1 Agreement
1.1 By engaging Castabroad Limited (in these conditions referred to as “Castabroad”) to make travel arrangements and bookings, you agree to the following terms and conditions:
2 Deposit
2.1 A non refundable deposit of $1000 per person is payable no later than two months prior to commencement of the holiday.
2.2 Payment of a deposit constitutes acceptance of the terms and conditions in this Agreement
3 Payment
3.1 Payment in full is required no later than 45 days prior to commencement of the holiday. Castabroad can not guarantee bookings at the quoted price unless this requirement is complied with.
4 Cancellation and Refunds
4.1 If the holiday is cancelled, a refund may be available depending upon the amount of notice received.
4.2 If more than 45 days notice of cancellation is received, Castabroad shall be entitled to retain the non refundable deposit, but shall, subject to clause 4.5, refund in full any other monies paid by the customer.
4.3 If more than two weeks, but less than 45 days notice of cancellation is received, Castabroad shall be entitled to retain the non refundable deposit, as well as 50% of all other monies paid by the customer.
4.4 If less than two weeks notice of cancellation is received, Castabroad shall be entitled to retain the non refundable deposit, as well as all other monies paid by the customer.
4.5 Castabroad may deduct from any amount repayable to the customer in accordance with the above policy:
a) Any amount charged to Castabroad as a cancellation charge or penalty by any of Castabroads suppliers in respect to the cancellation of the holiday.
b) Any amount retained by or payable to an accommodation provider in accordance with that providers cancellation/refund policy.
5 Exclusions
5.1 Castabroad is not liable for travel costs for travel that is not travel within New Zealand unless otherwise agreed in writing.
5.2 Castabroad is not liable for any of the following:
a) Travel insurance (although Castabroad strongly recommends that you arrange travel insurance)
b) Departure taxes and other Airport charges
c) Excess baggage charges
d) Food and beverage (unless specifically included in any package)
e) Laundry, telephone or internet charges not expressly included in the accommodation package
f) Any medical expenses incurred by you in the course of the holiday
g) Gratuities
5.3 Castabroad is not liable for any other cost incurred by you except as, and to the extent previously agreed in writing signed by a director of Castabroad.
6 Biosecurity
6.1 The customer shall be solely responsible for ensuring that they comply with the provisions of the Biosecurity Act 1993 and the Customs and Excise Act 1996. In particular, the customer shall ensure that all fishing equipment and other equipment brought into New Zealand have been properly treated so as to comply with New Zealand’s border control rules and regulations.
7 Currency
7.1 All amounts payable pursuant to this agreement shall, unless otherwise agreed, be payable in New Zealand dollars to Castabroad’s nominated bank account in New Zealand. All bank charges associated with the transfer of funds are your responsibility. When transferring funds you should make allowance for fees and charges imposed by the receiving bank in New Zealand.
8 Jurisdiction
8.1 This agreement shall be deemed to have been made in New Zealand, and shall be subject to the laws of New Zealand and the jurisdiction of the New Zealand Courts.
9 Liability
9.1 The liability of Castabroad, its officers, directors and employees is strictly limited. Castabroad coordinates travel services, sightseeing and fishing excursions and accommodation that it purchases or reserves from various suppliers (“Suppliers”). Castabroad does not own or operate any of these Suppliers. All suppliers are independent of Castabroad and are not agents or employees of Castabroad. Castabroad is not liable for any direct, indirect or consequential loss, damage or injury suffered by you occasioned by reason of any act or omission beyond its control, including any act or omission on the part of any one or more of the Suppliers or of any other third party.
9.2 Without incurring any legal liability, Castabroad’s policy is to use its best endeavours to assist its customers in the event of loss, damage, injury or inconvenience. Normally this will entail Castabroad acting as a go-between between you and any service provider. Castabroad can not however give any guarantee or accept any liability in respect to the actions of others.
10 Medical conditions
10.1 Fishing trips organized by Castabroad may involve walking and navigating terrain which requires participants to have a moderate level of fitness and mobility. If you have any physical, emotional or mental condition that may require professional attention or the use of special equipment during the trip you must draw this to Castabroad’s attention at the time you make your booking. Castabroad reserves the right not to accept booking from any person if Castabroad is of the opinion that that person suffers from any condition or disability which would make participation in the activity a danger to that person or any other person. Trips organized by Castabroad are unsuitable for people in wheelchairs or motorized scooters, or who otherwise require assistance in walking.
10.2 Castabroad is not responsible if you are unable to participate in any booked activity as a result of a disability that you failed to disclose to Castabroad at the time of booking. The obligation is on you to make Castabroad aware of all circumstances that may impact on your ability to participate in the holiday booked.
